Default 2012 Suburban transmission fluid insanely overfilled

After driving my 2003 Suburban for 6 years, I decided it was time for a new(er) one. I purchased a 2012 Suburban around 6 pm and by 7:30 pm it wasn't moving. My husband had me pull over and pop the hood. He was furious when he found that the trans fluid had been filled way too much. I'm talking at least 5 inches past the kink in the dipstick. It drove fine during the test drive, no warning lights on. The truck is currently parked in a parking lot and we're going to attempt to drain the fluid in the morning. Is the tranny problem a result of the overfilling or was it already going bad? I would think that there would've been done signs/symptoms beforehand, no? Obviously the dealership won't be open again until Tuesday due to the holiday weekend but I'm currently losing sleep over this.

Think I wouldn't touch it again till the dealer is open and give them the opportunity to make it right.

My husband drained 3-4 quarts of excess fluid and I limped to a transmission repair shop. As I turned down the street it started driving fine. He hooked it up, cleared the codes and took it for a drive. He came back saying that it driver great and is s beautiful car. About 2 miles from home it started acting up again and I'm currently sitting at the bottom of my driveway because I can't get up the hill.

When I turn it off for a few and let it sit, it runs okay for a few minutes and then starts slipping again.
