2nd bad ABS modulator 3 weeks off warranty. Any recourse?
My mother-in-law is 84 years old and has a 2010 Malibu LTZ with 32,000 miles. Car is in great condition. Last November, she had to replace the EBCM & the ABS modulator (BPMV). The ABS modulator had a 1-year warranty. However, in May 2018, it was changed to a 2-year warranty. That 2-year warranty does not apply to her (according to the dealership) because her ABS modulator was installed six months before the warranty extension date. Thursday, her ESC, TCS, and assorted ABS warning lights came on. She took it back to the dealership, and they told her that the ABS modulator needed to be replaced again for $1300. I live two states away but called the service tech. The code they pulled with the Tech III scanner was C0110 (I think -04). She has put less than 2000 miles on the car since we had the part replaced in November 2017. He said there was nothing he could do because the 1-year warranty has expired. He transferred me to the Director of Parts and Service, who tried to tell me that the ABS modulator went bad because she is not driving the car enough. He finally claimed he would contact GM and see if there was anything GM could do. I’m expecting him to come back and say there is nothing GM or the dealership can (i.e., will) do. Any advice?
