Default California Smog BS

Today I went to get a smog, because it would be nice to get up to date tags. But instead the guy at the smog place said it's a fail because of the aftermarket Intake/Air Cleaner which doesn't have a CARB stamp or sticker...we have owned the vehicle since 2011 when we bought it from a used car dealership and never modified it, besides me replacing the Pitman arm and Idler Arm, Radiator and power steering lines it is all stock or so I thought....it broke down a couple months after we purchased it and has been non opped, until 2 weeks ago. I will attach a picture of what is considered a failure. I Cant find any information on it besides it is a K&N Filter on an Stillen Hi-flow tube(which has no serial number). Did it rightfully fail the visual inspection because of that?
