Default 88 problems setting brake light switch

I bought a new brake light switch, cause I couldn't get them to come on. Now I set it and then after a few times of using the brakes there stay on. I have rest it a few times now, I did as the instutions said. Which is push the pedal down all the way then move the arm all the way forward (back towards the seat. I think that it's doesn't have enough tension on it and wants to slip. I took it apart and peened the rivet somemore but no luck.

It was one that I bought at adavavnced should I go buy one at NAPA or Auto Value like this one might just be a cheap piece of crap?
