It states that GM knew about the defect since 2007 but never informed consumers, leading to many unnecessarily destroyed engines.

Maybe. But when you lose a case, don't they usually make you pay the other side's legal fees? In that case dragging it out could end up making the settlement more expensive.

You have a point though, it does raise the bar for anyone who wants to start a lawsuit.

According to the lawsuit, the Vortec engines burn abnormally high amounts of oil that is way above industry standards, resulting in low oil levels and engine damage.

The lawsuit alleges the TSBs admit the 5.3-liter engine problems are caused by PCV issues, problems with the piston rings and flaws in the active fuel management systems.

The GM 5.3-liter engine lawsuit was filed in the U.S. District Court for the Northern District of Ohio, Cleveland Division - Szep, et al., v. General Motors LLC.
The judge threw out the case.

"Notably, these types of allegations concern a defect in design. As a result, the court finds that Plaintiff’s breach of express warranty claim fails.”"

“Plaintiff does not assert that he suffered injury in any other state. As a result, the court finds that Szep does not have standing to maintain his nationwide class allegation…” concludes the order.

The judge concluded that the plaintiff had not shown “an inference that GM had knowledge of the oil consumption defect.”


( I talked to an engineer who worked on this problem at GM. They DID know)

of course they did. they monitor everything. They have a entire division that does nothing but inspects returned warranty parts.
