Ah, my bad, I can see how confusing my post was. Sometimes I let my mind go wherever it may. The guy in "dark, non-reflective clothing" was meant to be likened to one who intentionally disables the DRL, a safety feature that's intended to make his vehicle more visible. And, yes, the judge basically sided with my friend on the negligence charge.

Well just as your mind is able to go wherever it may, so arent the folks who wish to do what they want to their vehicles. I have a white Pontiac Bonneville sedan and disabled my DRL's soon after ownership, and have never ever hit a pedestrian. Hmmm operator skill comes into play here as well, but to each their own...... You enjoy your DRL's if not disab...errr I mean if so equiped.
